Within this framework, the KVK Policy includes all personal data processing activities within the scope of the Law carried out by the Company for persons other than Metra Kabin employees and<\/p><p>It covers the owners of all personal data whose personal data is processed by Metra Kabin. Issues regarding the processing of personal data of METRA KABIN employees are further regulated in Metra Kabin Ve Ba\u011flant\u0131 Elemanlar\u0131 Sanayi Ticaret Anonim \u015eirketi Employee Personal Data Processing and Protection Policy.<\/p><ul><li><strong>Enforcement and Amendment<\/strong><\/li><\/ul><p>This PDP Policy is valid from the date it is approved by METRA KABIN and entered into force. The Company reserves the right to make changes in the KVK Policy in parallel with legal regulations.<\/p><p>In case of any conflict between the legislation in force, particularly the Law, and the regulations in this PDP Policy, the provisions of the legislation in force shall apply.<\/p><ol start=\"2\"><li><strong>DATA SUBJECTS, DATA PROCESSING PURPOSES AND DATA CATEGORIES FOR THE PERSONAL DATA PROCESSING ACTIVITIES CARRIED OUT BY OUR COMPANY<\/strong><ul><li><strong>Data Subjects<\/strong><\/li><\/ul><\/li><\/ol><p>Data subjects within the scope of the PDP Policy are all natural persons other than METRA KABIN employees whose personal data are processed by METRA KABIN. These principles must be complied with for each personal data processing activity:<\/p><ul><li>Processing of personal data in accordance with the law and good faith; METRA KABIN acts in accordance with the relevant laws, secondary regulations and general principles of law in the processing of personal data; attaches importance to processing personal data limited to the purpose of processing and taking into account the reasonable expectations of data subjects.<\/li><li>Accuracy and timeliness of personal data; METRA KABIN pays attention to whether the personal data processed by METRA KABIN is up to date and checks are made in this regard. In this context, data subjects are given the right to request correction or deletion of their inaccurate and outdated data.<\/li><li>Processing of personal data for specific, explicit and legitimate purposes; METRA KABIN determines the purposes of data processing in accordance with the law before each personal data processing activity.<\/li><li>Personal data being relevant, limited and proportionate to the purpose for which it is processed; METRA KABIN limits the data processing activity by METRA KABIN to the personal data required to fulfil the purpose of collection and takes necessary steps to ensure that personal data not related to this purpose is not processed.<\/li><li>Retention of personal data for the period required by the legislation or processing purposes; In cases where a longer retention period is not determined by METRA KABIN in accordance with the law, taking into account the sector practices regarding the storage of personal data, the personal data processed by the Company is deleted, destroyed or anonymised after the purpose of processing personal data is eliminated or the period stipulated in the legislation expires.<\/li><\/ul><p>\u00a0<\/p><ul><li><strong>Conditions Regarding the Processing of Personal Data<\/strong><\/li><\/ul><p>Your personal data is processed by the Company in the presence of at least one of the personal data processing conditions specified in Article 5 of the Law. Explanations regarding these conditions are given below:<\/p><ul><li>In cases where the explicit consent of the personal data owner does not exist in the absence of other data processing conditions, in accordance with the general principles under the heading 3.1., METRA KABIN may process the personal data of the data owner if the data owner gives consent with his\/her free will, with sufficient information about the personal data processing activity, in a manner that leaves no room for hesitation and limited to that transaction.<\/li><li>Personal data may be processed by METRA KABIN without the explicit consent of the data subject if the personal data processing activity is explicitly stipulated by law. In this case, the Company will process personal data within the framework of the relevant legal regulation.<\/li><li>In the event that the explicit consent of the data subject cannot be obtained due to actual impossibility and personal data processing is mandatory, personal data belonging to the data subject who is unable to disclose his\/her consent or whose consent cannot be validated by METRA KABIN will be processed in the event that personal data processing is mandatory to protect the life or physical integrity of the data subject or a third person.<\/li><li>If the personal data processing activity is directly related to the establishment or performance of a contract, personal data processing activity will be carried out if it is necessary to process personal data belonging to the parties of a written or verbal contract established between the data subject and METRA KABIN.<\/li><li>In the event that it is mandatory to carry out personal data processing activities in order to fulfil the legal obligation of the data controller, METRA KABIN will process personal data in order to fulfil its legal obligations stipulated under the applicable legislation.<\/li><li>If the data owner has made his\/her personal data public, personal data that have been disclosed to the public in any way by the data owner, and personal data that have been made available to everyone as a result of publicisation, may be processed by METRA KABIN without the explicit consent of the data owners, limited to the purpose of publicisation.<\/li><li>In the event that personal data processing is mandatory for the establishment, exercise or protection of a right, METRA KABIN may process the personal data of the data owner without the explicit consent of the data owners within the scope of the obligation.<\/li><li>Provided that it does not harm the fundamental rights and freedoms of the data subject, if data processing is mandatory for the legitimate interests of the data controller, personal data may be processed by METRA CABIN, provided that the balance of interests of METRA CABIN and the data subject is observed. In this context, in the processing of data based on legitimate interest, the Company first determines the legitimate interest to be obtained as a result of the processing activity. It evaluates the possible impact of the processing of personal data on the rights and freedoms of the data subject and carries out the processing activity if it is of the opinion that the balance is not disturbed.<\/li><\/ul><p>\u00a0<\/p><ul><li><strong>Conditions Regarding the Processing of Special Categories of Personal Data<\/strong><\/li><\/ul><p>Article 6 of the Law specifies a limited number of special categories of personal data. These are; race, ethnic origin, political opinion, philosophical belief, religion, sect or other beliefs, appearance and dress, association, foundation or trade union membership, health, sexual life, criminal conviction and security measures, and biometric and genetic data.<\/p><p>\u00a0<\/p><p>METRA KABIN processes special categories of personal data in accordance with the relevant legal regulations and by ensuring that additional measures determined by the Personal Data Protection Board (\"PDP Board\") are taken in the following cases:<\/p><ul><li>Processing of special categories of personal data other than health and sexual life may be processed without seeking the explicit consent of the data subject if it is explicitly stipulated in the laws, in other words, if there is an explicit provision regarding the processing of personal data in the relevant law. Otherwise, the explicit consent of the data subject shall be obtained for the processing of such special categories of personal data.<\/li><li>Personal data relating to health and sexual life may be processed by persons or authorised institutions and organisations under the obligation of confidentiality for the purposes of protecting public health, preventive medicine, medical diagnosis, treatment and care services, planning and management of health services and financing, without seeking explicit consent. Otherwise, the explicit consent of the data subject shall be obtained for the processing of such special categories of personal data.<\/li><\/ul><p>\u00a0<\/p><ol start=\"4\"><li><strong>TRANSFER OF PERSONAL DATA<\/strong><\/li><\/ol><p>METRA KABIN may transfer personal data to third parties domestically or abroad in accordance with the additional regulations listed in Articles 8 and 9 of the Law and determined by the PDP Board; in case the conditions for the transfer of personal data exist.<\/p><ul><li>Personal data may be transferred by METRA KAB\u0130N to third parties in the country provided that at least one of the data processing conditions specified in Articles 5 and 6 of the Law and explained under Title 3 of this PDP Policy exists and provided that the basic principles regarding the data processing conditions are complied with.<\/li><li>Transfer of personal data to third parties abroad:<\/li><\/ul><p>In case the country to which the transfer will be made is one of the safe countries with adequate protection declared by the PDP Board; In the presence of at least one of the data processing conditions specified in Articles 5 and 6 of the Law and explained under Title 3 of this PDP Policy and provided that the basic principles regarding the data processing conditions are complied with, your personal data may be transferred by METRA KAB\u0130N to third parties abroad.<\/p><p>\u00a0<\/p><p>In the event that the country to which the transfer will be made is not one of the safe countries with adequate protection declared by the PDP Board; personal data may be transferred to third parties abroad in the following cases in the presence of at least one of the data processing conditions described under Title 3 of this PDP Policy and in accordance with the basic principles specified in Article 4 of the Law:<\/p><ul><li>Existence of explicit consent of the person concerned<\/li><li>The Company and the data recipient in the relevant country undertake adequate protection in writing and obtain the authorisation of the PDP Board for the relevant transfer<\/li><\/ul><p>Within the general principles of the Law and the data processing conditions in Articles 8 and 9, METRA KAB\u0130N may transfer data to the parties categorised in the table below:<\/p><table><tbody><tr><td width=\"133\"><p><strong>SHARED PARTY CATEGORISATION<\/strong><\/p><\/td><td width=\"269\"><p><strong>SCOPE<\/strong><\/p><\/td><td width=\"201\"><p><strong>PURPOSE OF TRANSFER<\/strong><\/p><\/td><\/tr><tr><td width=\"133\"><p>Business Partner<\/p><\/td><td width=\"269\"><p>It means the parties with which the Company establishes a business partnership while carrying out its commercial activities.<\/p><p>The business partners to whom personal data are transferred are given below together with the purposes of transfer.<\/p><p>- Business partner Banks for the execution of financial business processes<\/p><p>- Service providers based abroad for the purpose of conducting examinations, tests and inventory studies within the scope of recruitment activities<\/p><p>- Audit firms that are being worked with for the realisation of audit activities<\/p><p>- Law offices that are being worked with for legal counselling<\/p><p>- Independent jury members for the evaluation of scholarship applications regarding the scholarships to be provided<\/p><\/td><td width=\"201\"><p>Personal data are transferred in a limited manner in order to ensure the fulfilment of the purposes for which the business partnership was established.<\/p><\/td><\/tr><tr><td width=\"133\"><p>Supplier<\/p><\/td><td width=\"269\"><p>Parties that provide contractual services in accordance with the Company's orders and instructions while carrying out the Company's commercial activities<\/p><\/td><td width=\"201\"><p>Personal data are transferred limitedly in order to ensure the provision of services outsourced from the supplier and necessary to fulfil the Company's commercial activities.<\/p><\/td><\/tr><tr><td width=\"133\"><p>Legally Authorised Public Institution<\/p><\/td><td width=\"269\"><p>Public institutions and organisations legally authorised to receive information and documents from the Company.<\/p><\/td><td width=\"201\"><p>Personal data is shared limited to the purpose of requesting information by the relevant public institutions and organisations.<\/p><\/td><\/tr><tr><td width=\"133\"><p>Legally Authorised Special Authority<\/p><\/td><td width=\"269\"><p>Private law persons (e.g. independent auditors) authorised to obtain information and documents from the Company in accordance with the provisions of the relevant legislation.<\/p><\/td><td width=\"201\"><p>Personal data is shared limited to the purpose requested by the relevant private law persons within the legal authority.<\/p><\/td><\/tr><\/tbody><\/table><p>\u00a0<\/p><p>\u00a0<\/p><ol start=\"5\"><li><strong>DISCLOSURE OF DATA SUBJECTS AND RIGHTS OF DATA SUBJECTS<\/strong><\/li><\/ol><p>According to Article 10 of the Law, data subjects must be informed about the processing of their personal data before the processing of personal data or at the latest at the time of processing personal data. Pursuant to the relevant article, METRA KABIN, as the data controller, has established the necessary structure within the company to ensure that data subjects are informed in all cases where personal data processing activities are carried out. In this context;<\/p><ul><li>For the purpose of processing personal data, please refer to section 2.2 of the KVK Policy.<\/li><li>For the parties to whom personal data are transferred and the purpose of transfer, please refer to Section 4 of the KVK Policy.<\/li><li>Please refer to sections 3.2 and 3.3 of the PDP Policy to examine the conditions regarding the processing of personal data that can be collected through different channels in physical or electronic media.<\/li><li>The rights of data subjects as data subjects pursuant to Article 11 of the Law are listed below:<ul><li>To learn whether their personal data is being processed or not,<\/li><li>Request information if personal data has been processed,<\/li><li>To learn the purpose of processing your personal data and whether they are used in accordance with their purpose,<\/li><li>To know the third parties to whom your personal data is transferred domestically or abroad,<\/li><li>To request correction of personal data in case of incomplete or incorrect processing and to request notification of the transaction made within this scope to third parties to whom personal data is transferred,<\/li><li>Although it has been processed in accordance with the provisions of the Law and other relevant laws, to request the deletion or destruction of personal data in the event that the reasons requiring its processing disappear and to request notification of the transaction made within this scope to third parties to whom personal data is transferred,<\/li><li>To object if a result arises to your detriment by analysing the processed data exclusively through automated systems,<\/li><li>In case you suffer damage due to the processing of personal data in violation of the Law, to demand the compensation of the damage.<\/li><\/ul><\/li><\/ul><p>Applications for the data subject rights listed above <a href=\"https:\/\/metrack.com.tr\/\">https:\/\/metrack.com.tr\/<\/a> METRA KABIN by filling out the Data Owner Application Form at the address of METRA KABIN. Depending on the nature of the request, the application will be finalised free of charge as soon as possible and within thirty days at the latest; however, if the transaction requires an additional cost, a fee may be charged to the data owner according to the tariff to be determined by the PDP Board.<\/p><p>\u00a0<\/p><p>During the evaluation of the applications, METRA KABIN first determines whether the person making the request is the real right holder or not. However, the Company may request detailed and additional information for a better understanding of the request when deemed necessary.<\/p><p>Responses to data subject applications by the Company are notified to data subjects in writing or electronically. If the application is rejected, the reasons for rejection will be explained to the data subject with justification.<\/p><p>\u00a0<\/p><p>In the event that personal data are not obtained directly from the data subject; the Company carries out activities to inform the data subjects (1) within a reasonable period of time from the acquisition of personal data, (2) if personal data will be used for communication with the data subject, during the first communication, (3) if personal data will be transferred, at the latest during the first transfer of personal data.<\/p><p>\u00a0<\/p><p>\u00a0<\/p><p>\u00a0<\/p><ol start=\"6\"><li><strong>DELETION, DESTRUCTION, ANONYMISATION OF PERSONAL DATA<\/strong><\/li><\/ol><p>Pursuant to Article 7 of the Law, although it has been processed in accordance with the law, in the event that the reasons requiring its processing disappear, in cases where a longer retention period is not determined by METRA KABIN in accordance with the law, taking into account the sector practices regarding the storage of personal data, personal data is deleted, destroyed or anonymised by METRA KABIN ex officio or upon the request of the data owner, in accordance with the guidelines published by the Personal Data Protection Authority, periodic destruction periods and data owner application.<\/p><p>\u00a0<\/p><p>The personal data processed by the Company are handled on a categorical basis and maximum data retention periods have been determined for each category of personal data in line with the data processing process to which it relates.
